Hargeisa (Horn post) The Ministry of Foreign Affairs of Israel recently highlighted the 2005 Fact-Finding Report issued by the African Union (AU), underscoring the unique legal and historical position of Somaliland within African political history.

Legal Commentary on Somaliland’s Recognition considering the African Union 2005 Fact-Finding Report;

The AU Fact-Finding Mission clearly established that the union between Somaliland and Somalia:

It was never ratified legally:

The intended union lacked formal approval by all necessary legal and political instruments, rendering it null under international law.

Functionally failed (1960–1990):

The union did not operate as a legitimate or effective governing structure, leading to systemic governance breakdowns.

Creates a historically unique case for sovereignty restoration: The report explicitly recognizes that Somaliland’s pursuit of international recognition is distinct from secessionist claims elsewhere in Africa, as it seeks to restore pre-existing sovereignty rather than to break away unlawfully.

By emphasizing this report, the Government of Israel effectively reminds the African Union and the international community that Somaliland’s legal claim to sovereign recognition is grounded in historical fact and international legal principles.

From a legal perspective, recognition of Somaliland by Israel is fully justified. It does not contravene international law, as the territory is not secessionist; it is a legitimate restoration of sovereignty that existed before the failed and unratified union with Somalia. Moreover, the AU itself, through its 2005 report, indirectly affirms that the union’s collapse legitimizes Somaliland’s pursuit of independent statehood.
